These Terms apply to the public Website. They do not govern your use of DiligenAI, Threat.Digital APIs, datasets, software, monitoring services, reports, or other products or services provided under an order form, subscription, license, statement of work, or other agreement.
Those products and services are governed by the applicable agreement between you and Threat.Digital, which may include our Software & Data Terms and Conditions. If these Terms conflict with an agreement governing a Threat.Digital product or service, the applicable product or service agreement controls with respect to that product or service.
2. Permitted Use
You may access and use the Website for lawful informational and business purposes, subject to these Terms.
You may not:
- use the Website in violation of any applicable law or regulation;
- interfere with, disrupt, damage, disable, or impair the operation or security of the Website;
- attempt to gain unauthorized access to the Website, its systems, or systems connected to the Website;
- introduce malware, malicious code, or other harmful material;
- use automated means to scrape, harvest, systematically download, or extract Website content without our prior written permission, except for ordinary indexing by general-purpose search engines;
- circumvent technical measures intended to control or limit access to the Website; or
- use Website content in a manner that infringes or violates the intellectual property or other rights of Threat.Digital or any third party.
3. Intellectual Property
The Website and the text, graphics, software, designs, logos, reports, articles, and other materials made available through it are owned by Threat.Digital or their respective licensors or content providers and are protected by applicable intellectual property laws.
Except as permitted by applicable law or expressly authorized by us, you may not reproduce, modify, distribute, sell, license, publish, republish, create derivative works from, or commercially exploit Website content.
You may link to publicly available pages on the Website, provided that the link does not falsely imply sponsorship, endorsement, affiliation, or partnership with Threat.Digital.
4. Website Content and Informational Materials
The Website may contain articles, research, examples, product descriptions, demonstrations, regulatory information, risk-related information, and other informational materials.
Website content is provided for general informational purposes. It is not legal, regulatory, financial, investment, or other professional advice and should not be treated as a substitute for professional judgment or independent verification.
Information concerning laws, regulations, sanctions, enforcement actions, companies, individuals, or other subjects may change over time. You are responsible for verifying information that is material to any decision you make.
This section applies to content on the public Website. Any terms concerning data, research results, reports, or other information delivered through a Threat.Digital product or service are governed by the applicable agreement for that product or service.
5. Third-Party Content and Links
The Website may contain links to third-party websites, publications, sources, services, or other content. Threat.Digital does not control third-party websites or services and is not responsible for their availability, content, security, privacy practices, or accuracy.

6. Requests for Information and Demonstrations
You may use the Website to contact Threat.Digital, request information, or schedule or request a demonstration. Submitting a form, scheduling a meeting, requesting a demonstration, or communicating with us through the Website does not create a customer relationship, license, or obligation to provide services.
Any purchase, subscription, trial, proof of concept, access to software or data, or other commercial relationship is subject to any additional terms agreed between you and Threat.Digital.
7. Privacy
Information collected through the Website is handled as described in our Privacy Policy.
8. Website Availability and Changes
We may modify, update, suspend, restrict, or discontinue any part of the Website at any time. We do not guarantee that the Website or any particular content will always be available.
We may also correct errors, update information, or remove content from the Website without notice.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THREAT.DIGITAL DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT WEBSITE CONTENT WILL BE COMPLETE, CURRENT, OR ERROR-FREE.
Nothing in these Terms alters any express warranty or service commitment contained in a separate written agreement between you and Threat.Digital.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THREAT.DIGITAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE.
These limitations apply to claims relating to the public Website and do not modify any allocation or limitation of liability contained in a separate written agreement governing a Threat.Digital product or service.
Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by law.
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Threat.Digital and its officers, directors, employees, affiliates, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs and expenses arising from your unlawful use of the Website, your material violation of these Terms, or your violation of the rights of another person or entity.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Changes apply prospectively from the date they are posted.
Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles.
14. Severability and Waiver
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in effect.
A failure by Threat.Digital to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.
15. Entire Agreement Regarding the Website
These Terms, together with the Privacy Policy, constitute the agreement between you and Threat.Digital concerning use of the public Website. They do not supersede an order form, license agreement, software or data agreement, statement of work, or other written agreement governing a Threat.Digital product or service.
